Terms and Conditions

Please read before booking

The booking of our holiday property is a legally binding agreement for hiring the property for a specified period. It contains rights and obligations which are set out in these conditions called the “Hiring Conditions” and to which you agree by using the online booking system or signing the booking form.

You should only do so if you are satisfied that you understand and are prepared to be bound by them.

The Hiring Agreement (“the agreement”) is between you (“the hirer”) and the property owner.

1. Bookings

(a) The person who signs the Agreement certifies by doing so that he or she has the consent and authority to agree the terms of the Agreement on behalf of all intended occupants (including any later added). The signatory must be over eighteen years of age and bookings from young people under eighteen cannot be accepted.

(b) The booking is not treated as definite, that is, as the Agreement, until the deposit (30%) or full payment (if less than 8 weeks before stay) has been paid.

(c) Please note a booking made by telephone or online and not confirmed as above will not be treated as definite until payment is received. The booking must be confirmed by payment within 48 hours, or we reserve the right to release the property for hire by someone else.

(d) We, the owners reserve the right to refuse a booking without giving a reason.

2. Payment

(a) Where a deposit has been paid as above, the balance of the total cost of the holiday must be paid at least 8 weeks before the date on which the hiring is due to start.

(b) If a booking is made within eight weeks before the hiring is due to start then payment in full of all the hiring fees must be made.

(c) Once the booking has been confirmed and the agreement has come into existence the signatory is personally responsible for the total cost of hiring the property agreed.

3. The Owners Obligations

(a) To provide the holiday property you have chosen in a reasonable state of repair and condition, furnished and equipped to a fair and proper standard and in reasonable accordance with the description of the property on our website:

(b) To take reasonable steps to address properly and rectify as quickly as possible any problems which arise with the property during the hiring. (c) The property owner cannot be held responsible for any accident, loss or damage which may be sustained by any hirer, member of the party, or visitor or their property however caused.

(d) We should point out that we cannot be held responsible for any building or roadworks nor any countryside activities i.e. machinery, animals and rural activities carried out at or close to properties.

(e) The WIFI connection is provided by EE and the connection is not guaranteed, as the connection is not guaranteed by the ISP (EE). We do not charge for WIFI, however a fair use policy applies.

4. Hirers Obligations

(a) To leave the property in a clean and tidy condition. Please ensure particularly that the kitchen and all equipment and utensils and the bathroom are left clean and tidy;

(b) To inform the owners and pay for any damage and breakages at the property and to the contents before the departure;

(c) To permit the owners reasonable access to examine any matter of complaint raised during the hiring and to attend to any resulting repair or rectification or other urgent maintenance;

(d) Any complaints should be made to the owner as soon as possible and within 48 hours so that an investigation can be undertaken and any remedial action taken. It may be impossible to investigate a complaint thoroughly after you have left the property and this could affect or even extinguish your rights. It is therefore in your interest to act promptly.

(e) Not to share the property with anyone not nominated in the booking form or to sublet the property or assign the booking to anyone else;

(f) Not to exceed the maximum number of persons stated in the cottage description to be allowed to occupy the property. Please note that the right to terminate the Agreement immediately without refund or compensation on breach of this or the previous condition (4 (e);

(g) Any special requirements must be made known at the time of the booking. If you have any medical problem or disability that may affect your holiday, please tell us before confirming your booking and follow up with written details. If we feel unable to properly accommodate the particular needs of the person concerned we reserve the right to cancel the booking.

(h) Not to smoke anywhere in the cottage. Failure to comply with this will result in termination of contract.

(i) To lock the doors and close the windows when you leave the property unoccupied. Please note that in the event that keys issued are not returned at the end of your stay, then the cost of replacement will be charged to you.

(j) To respect neighbors with regard to inappropriate behavior and noise.

(k) Not to remove any inventory form the property. Beach towels are not provided and the towels provided are not to be used outside the property.

(l) To agree to Treicert Farm Cottages recycling policy, as explained on arrival at the property.

5. Pets

(a) Pets are allowed in all of our cottages with prior agreement. This number must not exceed 2 in any circumstances; any damage done by any pet must be paid for.

(b) Consent to pets being permitted in the property is in all circumstances dependent upon the type or breed being declared on the booking form and upon there being no variations on arrival at the property. The right is reserved to terminate the hiring forthwith if there has been any material error or omission in any such declaration;

(c) Pets must NOT be left alone in the property at any time;

(d) Pets must NOT be allowed on to any bedding or soft furnishing in the property and must be provided by the hirer with their own bedding or blanket to protect the owner’s floor coverings and furnishings. Pets are NOT allowed in any of the bedrooms or carpeted areas of the cottage.

The right to regulate and implement these conditions with relation to pets will vest solely with the owner. Allergies – If any member of the holiday party suffers from an allergy to pets please advise at the time of booking.

(e) Pets MUST be kept on a lead at all times when walking around the farm.

(f) Pets must not cause any annoyance in any way to neighboring properties.

(g) In outside areas where pets defecate, it must be removed and disposed of immediately.

6. Cancellations and Insurance

(a) It is essential that if you are obliged to cancel your holiday for any reason, that the facts are reported to us as soon as possible so that an effort can be made to re-let the cottage.

If the cancellation is notified to us more than 8 weeks prior to the original start date, only the non-refundable deposit of 30% will be retained. Any other monies paid will be returned to you. We do understand that on occasion, guests do need to change their booking dates and therefore we will try to be flexible where possible. If we are able to re-let the property we will transfer your deposit for use against a future date within 1 year.

If the notice of cancellation is received less than 8 weeks prior to the original start date and we are unable to re-let the property for the same period, the rental will be payable by you in FULL. Where it is re-let, the non-refundable deposit of 30% will be retained but can be used against a future holiday within 1 year and any other monies returned to you.

WE STRONGLY ADVISE YOU TO CONSIDER TAKING OUT APPROPRIATE HOLIDAY CANCELLATION INSURANCE.

(b) Once an Agreement has been made in accordance with these conditions any request to change the terms of the Agreement as the period of occupancy or identity of the property booked has to be treated as a cancellation and the above conditions will apply although every effort will be made to accommodate changes requested by a Hirer more than two months before the date on which the holiday is to commence. A charge of £50 per week will be incurred.

(c) We reserve the right to make reasonable amendments or additions to these terms and conditions without notice.

All our cottages are privately owned by us. We expect all our guests to enjoy the facilities and treat the cottages with the same respect that they would with their own home.

(d) Covid 19
We will offer a change of date or refund of all monies paid for the holiday if government travel restrictions prevent your stay.
If you need to cancel or move your dates to due sickness or self isolation we cannot offer a change of dates or refund. We will however look at each case separately.
Due to the pandemic, there is now insurance widely available for individuals in order to cover cancellation due to Covid related illness.
WE STRONGLY ADVISE THAT ALL GUESTS TAKE OUT THEIR OWN TRAVEL INSURANCE, as per government guidelines.

7. Arrival and departure

Please note that all properties hired must be vacated by 10.00am on the morning of departure and due to requirements for cleaning and replacing bed linen etc. are not available for occupation before 4.00pm on the date the holiday is due to start. Please contact us if there are any issues with these times.

8. Force Majeure Event

The owner shall NOT be in breach of these conditions nor liable for delay in performing or failure to perform any of the obligations set out in these conditions or otherwise, if such delay or failure results from events, circumstances or causes beyond our reasonable control.

Should a Force Majeure Event occur during the rental period, the owner will do all that is reasonably practicable to provide the hirer with alternative accommodation. However, should alternative accommodation not be found or accepted by the hirer, the owner shall not be liable to the hirer for any loss incurred by them for the events that are outside the owner’s control.

Again, we STRONGLY ADVISE taking out adequate travel insurance.

9. Guest becoming sick or displaying signs of Covid 19 whilst in our property

If a guest is displaying signs of the Covid-19 virus while staying in our property, they should inform us immediately and self-isolate where they are to minimise any risk of transmission, and request a test. If they are confirmed to have Covid-19, they should return home if they reasonably can. If a guest cannot reasonably return home (for example because they are not well enough to travel or do not have the means to arrange transport), their circumstances should be discussed with an appropriate health care professional and, if necessary, the local authority. Guests should follow government guidance on dealing with possible or confirmed coronavirus (COVID-19) infection.

Should the guest up staying they will be liable to pay for all affected bookings as a result of their extended stay. (That covers other cancellations where other guests leave because of the presence of a COVID sufferer onsite).

This condition is consistent with up to date government guidance relating to stays in overnight accommodation.
